Theme and Plugin Licensing
All of our themes and plugins are licensed under the GNU General Public License version 2 (GPLv2), which can be found at http://www.gnu.org/licenses/gpl-2.0.html.
Delivery
After we have successfully processed your payment, you will receive an email with the download link. If you do not receive an email with the download link, please contact us.
Ownership
You may not claim intellectual or exclusive ownership rights to any of our products. All products are property of Max Foundry, LLC. They are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products.
Support
Max Foundry, LLC offers themes and plugins “as-is” and with no implied meaning that they will function exactly as you would like or will be compatible with all 3rd party components and plugins. We offer no support of WordPress or WordPress themes and plugins that we do not develop.
Support is offered via email and is provided for a term of 1 year from the time of purchase. After 1 year a new license will need to be purchased in order to continue receiving support.
Upgrades
Upgrades are available to customers who have purchased a licensed version of our products. A Single-Site License provides upgrades for a single site and a Multi-Site License provides upgrades for unlimited sites.
Upgrades are provided for a term of 1 year from the time of purchase. After 1 year a new license will need to be purchased in order to continue receiving upgrades.
Forms of Payment
All transactions are made using PayPal, which accepts most major credit cards as forms of payment. We do not accept purchase orders, checks, or invoices to be paid at a later date.
When You Are Billed
When purchasing a product from our website, you are billed immediately for that product.
Refunds
Effective January 16, 2012, because you are purchasing non-tangible, digital goods, we do not offer refunds. However, if you purchased a product before January 16, 2012 and request a refund within 30 days from the date of purchase, we will honor that refund. This excludes the MaxBundle, which was not eligible for refunds prior to January 16, 2012.
All sales are final.
Price Changes
Max Foundry, LLC reserves the right, at any time, to modify or discontinue, temporarily or permanently, a license with or without notice. Prices of all products are subject to change. Notice of price changes will be made on the site.
Warranty
Our themes and plugins are guaranteed to function on a clean installation of WordPress. We do not guarantee it will function with all 3rd party plugins or web browsers. We are not responsible for any plugin compatibility conflicts that may occur. It is our policy to support our themes and plugins as best we can and we will provide support for 3rd party plugin conflicts at our discretion or as time allows. We are not responsible for any data loss that may occur as a result of installing any of our themes and plugins.
We reserve the right to change or modify current Terms and Conditions with no prior notice.
